These Terms govern your use of pzrolabs.com and the products operated byPZRO Labs LLC (“PZRO Labs,” “we,” “us”), including TurboCast, Cabana, and GameHero (the “Services”). By using the Services you agree to these Terms. If a product presents its own terms, those terms apply to that product and control where they conflict with these.
1. Accounts
You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account. If you use the Services on behalf of an organization, you confirm you have authority to bind it to these Terms.
2. Acceptable use
You agree not to:
- break the law or infringe anyone's rights;
- upload malware or attempt to disrupt, probe, or gain unauthorized access to the Services;
- send spam or use the Services to harass others;
- resell or reverse engineer the Services except where the law permits it.
3. Your content
You keep ownership of the content you put into the Services. You grant us a limited license to host, store, process, and display it solely to operate and improve the Services for you. You are responsible for having the rights to the content you upload.
4. Subscriptions and payment
Paid plans are billed in advance on a recurring basis until cancelled. You can cancel at any time; access continues through the end of the current billing period. Fees are non-refundable except where required by law or stated otherwise in a product. Purchases made through the Apple App Store are also subject to Apple's terms, and refunds for those purchases are handled by Apple.
5. Our intellectual property
The Services, including their software, design, and trademarks, are owned by PZRO Labs and protected by law. These Terms do not grant you any rights to our trademarks or branding.
6. Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if needed to protect the Services or other users. Where reasonable we will give notice and a chance to export your data.
7. Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the fullest extent permitted by law, PZRO Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Services is limited to the amount you paid us for the Service in the twelve months before the claim arose, or US $100 if greater.
9. Indemnity
You agree to indemnify PZRO Labs against claims arising from your content or your misuse of the Services.
10. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located there, unless applicable law requires otherwise.
11. Apple App Store
If you download an app from the App Store, you acknowledge that these Terms are between you and PZRO Labs, not Apple, and that Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your use of the app.
12. Changes
We may revise these Terms. We will update the date above and, for material changes, give reasonable notice. Continued use after changes take effect means you accept them.
